Public offer for ACCA courses at FCS ACADEMY

This English version is a translation provided for convenience. The Uzbek and Russian versions prevail.

1Public offer

1.1Agreement and course

1.1.1

NEXIA ACADEMY LLC (TIN 313249948), operating under the FCS ACADEMY brand (the "Academy"), provides ACCA exam preparation services. The person ordering the services is the "Customer", and the person studying is the "Student".

1.1.2

The course programme, language, format, start date, schedule, total study hours and the length of one study hour, the course price and the payment terms are shown on the course page before purchase. The Offer, the Refund Policy and the confirmed course details form the terms of the agreement.

1.1.3

Before paying, the Customer checks the details of the chosen course, ticks the box agreeing to the Public Offer and the Refund Policy, and makes the agreed advance payment. Performing these actions is acceptance of this offer; the agreement is concluded when the Academy receives confirmation of payment. A failed or cancelled payment does not activate access to the course.

1.1.4

The course does not guarantee passing an ACCA exam, membership or employment. ACCA registration, exam and membership fees are not included in the course price unless separately agreed. The Student provides the device and internet connection for online classes.

1.2Payment and attendance

1.2.1

The course is provided on a monthly advance-payment basis before the start of each study month. A study month need not match a calendar month; its start and end dates are stated in the order details. The total course price, the monthly payment amount and the payment schedule are provided before purchase. This arrangement is not an automatically renewing monthly subscription. No automatic recurring charges are made to the card.

1.2.2

Prices are shown in Uzbek soum. Payment is made to the bank account or through the bank payment form on the website. Discounts and any applicable bank fees are disclosed in advance.

1.2.3

Once payment is confirmed, the Student may attend classes and access materials in the private Telegram channel. If a payment deadline is missed, access is suspended with written or electronic notice. Once the overdue payment is confirmed, access to classes and the Telegram channel is restored. If the delay exceeds 10 calendar days, the Academy may terminate the agreement with written or electronic notice and settle accounts for the services provided. The Academy does not automatically charge for classes it did not provide because access was restricted.

1.2.4

The Student follows the schedule, completes assignments and treats others with respect. Missing a class provided by the Academy for personal reasons is not grounds for recalculating the course fee. If no notice of stopping the course is given and the agreed services have actually been provided in full, with the Student able to take part, the full agreed course price is payable. This rule does not allow charging for services not provided or limiting mandatory consumer rights.

1.3Videos and materials

1.3.1

Recordings of live classes and additional materials are provided free of charge in a private Telegram channel only to Students who studied in that group while the classes were held. If the Student stops the course, is lawfully expelled or does not make an advance payment when due, access to the channel and all of its materials ends.

1.3.2

A Student who has completed the course and paid for it in full keeps free access for 3 calendar months after the course ends. After that period the Student is removed from the Telegram channel. Further access is available for a separate fee covering only the videos and materials. The price and access period are agreed in advance; no automatic charges are made.

1.3.3

Materials are provided for personal study only. Without the Academy's written or verifiable electronic permission, it is prohibited to pass on, sell or distribute them to third parties or to give third parties access through an account.

1.3.4

If a culpable breach of this condition by a person who accepted it in writing or in an electronic form permitted by law is proven by evidence, the Academy may claim a one-time contractual penalty of 10,000,000 (ten million) soum per course. A reasoned written claim is sent; the penalty is not deducted automatically. Disputes are resolved in accordance with the law; the court's power to reduce the penalty is preserved.

1.4Changes and termination

1.4.1

If the schedule or the tutor changes, the Academy gives advance notice and keeps the scope and quality of the programme. If important terms change significantly, the Customer may accept an alternative or request termination and settlement. A cancelled class is rescheduled or its price is recalculated.

1.4.2

Threats, insults, deliberate repeated disruption of classes or unauthorised distribution of materials are grounds for expelling the Student from the course. The Academy states the reason in writing and, unless immediate protective measures are needed, gives an opportunity to correct the breach. Payments are not withheld automatically; settlement and damages are handled in accordance with the law.

1.4.3

In the event of force majeure, the parties promptly notify each other and agree how to continue. If the circumstances last more than one month, the agreement may be terminated and unprovided services settled.

1.4.4

Requests are reviewed within 5 working days. Disputes are resolved through negotiation, a competent authority or the courts. A new version of the offer applies to new orders; the terms of an existing order are not changed without the parties' agreement.

2Refund policy

2.1

This policy is an integral part of the offer. If a live course is cancelled before it starts, the payment is refunded in full. If the Academy cancels the course and the Student does not accept an alternative, the fee for services not provided is refunded. Erroneous, duplicate and excess payments are also refunded.

2.2

After the course has started, notice of stopping is sent to info@nexiauzbekistan.uz or given by phone at +998 (90) 335-82-25. Please state your full name, the course, your contact details and any information available to identify the payment. The Academy records the notice; the date it is received is the basis for the settlement. Simply no longer attending classes is not notice of stopping the course.

2.3

Value of services provided = total discounted course price ÷ total agreed study hours × hours held before the notice was received and available for the Student to attend.

2.4

Refund amount = amount paid − value of services provided. A positive difference is refunded; a negative difference is shown as a debt for services provided. Classes after the notice, and classes cancelled or not provided by the Academy, are not counted. Legal claims regarding poor-quality services are considered separately.

2.5

A discount is not reversed because of cancellation. No separate fee or penalty is charged for ending access to free materials. The penalty for unauthorised distribution is governed by a separate rule in the offer. Bank fees are taken into account only when disclosed in advance and legally justified; the costs of a cancellation caused by the Academy are not passed on to the customer.

2.6

The calculation and a reasoned reply are sent within 5 working days. The refund order is sent to the bank within a total of 10 working days from receipt of the request; any shorter mandatory legal deadline prevails. Funds are usually returned to the original payer's card or account; another method is agreed in line with bank requirements. The Academy provides confirmation of the refund and follows up any delay at the bank.

2.7

For payments made with a bank loan, the refund follows the bank's procedure; cancelling the course does not automatically cancel the loan. The reason for any refusal or deduction is explained in writing. The Customer may request a review or apply to a competent authority or the courts.

3Privacy policy

3.1

Data and purposes. Full name, phone, email, course and study details, payment status, transaction details and correspondence are processed on a lawful basis to organise the course, perform the agreement, settle payments and refunds, and for security. Passport details or a personal identification number (PINFL) are requested only when there is an explained legal need. The purpose, data and duration of any consent-based processing are disclosed in advance.

3.2

Consent. Separate, voluntary consent is obtained for advertising, for using photos and videos in marketing, and for publishing exam results with a name. Refusing does not restrict access to the course.

3.3

Payments and recipients. Card payments are made through a secure payment form provided by "IPAK YO'LI" JSCB OPERU. The Academy receives the order and payment status, the amount and the confirmation details needed to identify the transaction. Authorised staff and service providers have access to the data they need; data is shared with the bank and state bodies on a lawful basis. Data is not sold for marketing.

3.4

Rights. To obtain information about your data, correct it, stop its processing or have it destroyed where the law allows, or to withdraw consent, contact info@nexiauzbekistan.uz. Identity is verified only as far as necessary. Withdrawing consent does not mean immediate deletion of documents that must be kept on another legal basis. Requests are reviewed within the legal deadlines; the right to complain to a competent authority or a court is preserved. An updated policy is published with its date; any new consent that is needed is obtained separately.
